Terms of Service

These Terms of Service (“Terms”) govern your use of the VibifyLab website at www.vibifylab.com and the web design and development services provided by VibifyLab (“we”, “us”, or “our”). By accessing the Site or commissioning services, you agree to these Terms.

1. Services

VibifyLab provides digital services including, but not limited to:

• Landing page design and development.
• Multi-page business websites.
• E-commerce store setup.
• Website redesigns.
• Performance and SEO optimisation.

The specific scope, deliverables, timeline, and fees for each project are agreed upon in writing before work begins.

2. Quotes & Pricing

All quotes are estimates based on the information provided by the client. Final pricing is confirmed in the project agreement. Any additional work outside the agreed scope may incur extra charges and will be quoted and approved before being carried out.

3. Payment Terms

Unless otherwise agreed in writing:

• A non-refundable 50% deposit of the total project fee is required before any work begins.
• The remaining 50% is due upon project completion and must be paid before the website and source files are delivered.
• Work will not start until the initial deposit payment has been received and confirmed.
• Late payments may delay project delivery or final handover.

4. Client Responsibilities

To complete a project efficiently, the client agrees to:

• Provide all required content, branding materials, and account access in a timely manner.
• Respond to requests and feedback within reasonable timeframes.
• Review deliverables carefully and communicate revision requests clearly.

Delays caused by missing information or late feedback may extend the project timeline and may affect pricing if the scope changes.

5. Client Account Access

Clients may provide us with access to third-party accounts and services required for development, such as hosting platforms, payment providers, databases, APIs, and other tools.

Access to these accounts and credentials is used solely for completing the agreed project. We do not use, share, or retain client credentials, API keys, or sensitive access information for any purpose outside the project.

After project completion and handover, access credentials will be removed from our systems where applicable, and clients are responsible for changing passwords and managing account security thereafter.

Clients remain the owners of their accounts, subscriptions, services, and API keys. VibifyLab is not responsible for outages, price changes, security issues, or service interruptions caused by third-party providers such as hosting, payment, database, or API services.

6. Revisions

The project agreement specifies the number of revision rounds included. Revisions cover adjustments to existing approved designs, not complete redesigns. Additional revisions or changes to the agreed scope may be billed separately.

7. Intellectual Property

Upon full payment, the client owns the final design and content created specifically for the project. We retain ownership of pre-existing tools, code libraries, process documentation, and any stock resources licensed through third parties unless otherwise agreed in writing.

8. Cancellations & Refunds

Either party may cancel the project by providing written notice. If work has already begun, the client is responsible for payment for the portion of work completed up to the cancellation date. Deposits are generally non-refundable unless otherwise agreed.

9. Liability

We are not liable for any indirect, incidental, or consequential damages arising from the use of our services or website. Our total liability is limited to the amount paid by the client for the specific project giving rise to the claim.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Serbia. Any disputes arising from these Terms shall be resolved in accordance with applicable laws and the jurisdiction of the competent courts of the Republic of Serbia.

11. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the Site or our services after any changes constitutes acceptance of the updated Terms.
